Privacy policy
The protection of your personal data is important to us. We process your data exclusively on the basis of the applicable statutory provisions (GDPR, Austrian Telecommunications Act 2021 [TKG 2021]). In this policy we inform you about the most important aspects of data processing in our online shop.
Controller
Liquid Ice e.U., owner Karen Reichardt, Am Ölberg 161/1, 3400 Klosterneuburg, Austria. Email: hello@liquidice.com
Hosting and Shop System
Our online shop runs on the Shopify platform. The provider for Europe is Shopify International Ltd., c/o Intertrust Ireland, 2nd Floor 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland. When the shop is accessed, Shopify processes technically necessary data (e.g. IP address, date and time of access, browser type) in server logs in order to provide the shop securely and reliably. The legal basis is our legitimate interest in reliable operation (Art. 6(1)(f) GDPR). Shopify may transfer data to its parent company Shopify Inc. in Canada; the European Commission has adopted an adequacy decision for Canada. More information: https://www.shopify.com/legal/privacy
Orders, Payment and Shipping
When you place an order, we process the data required for it (e.g. name, billing and delivery address, email address, telephone number, ordered goods, payment method) in order to perform the contract (Art. 6(1)(b) GDPR). Payment data is received by the payment service provider of the payment method selected at checkout, the delivery address by the shipping company we use. We keep invoice and order data for as long as statutory retention obligations require (Art. 6(1)(c) GDPR).
Contact and Partner Inquiries
If you contact us via an inquiry form or by email, the data you provide (e.g. company, name, email address, telephone number, message) is stored by us in order to process your inquiry and in case of follow-up questions. We do not pass this data on without your consent. Legal basis: pre-contractual measures or legitimate interest (Art. 6(1)(b) and (f) GDPR).
Newsletter (The Cold Front)
If you sign up for our newsletter, we use your email address and the language of the page you signed up on to send the newsletter. You can unsubscribe at any time — via the unsubscribe link or informally by email to hello@liquidice.com. Legal basis: your consent (Art. 6(1)(a) GDPR).
E-mail via Klaviyo
We send newsletters and automated e-mails (for example a reminder about a checkout you did not complete, a message after your order or a reminder to restock) through Klaviyo (Klaviyo, Inc., 125 Summer Street, Boston, MA, USA). For this, Shopify passes your e-mail address, your name, your language and order and cart data to Klaviyo. If you consent in the cookie banner, Klaviyo also records which pages and products you view in our shop. Legal basis: for newsletters, marketing e-mails and recording your visit, your consent (Art. 6(1)(a) GDPR); for e-mails needed to process your order, performance of the contract (Art. 6(1)(b) GDPR). Klaviyo is certified under the EU-US Data Privacy Framework; transfers to the USA rely on the European Commission's adequacy decision (Art. 45 GDPR).
Reviews (Judge.me)
For product reviews we use Judge.me (Judge.me Ltd, 1-3 Worship Street, London EC2A 2AB, United Kingdom). After an order, Judge.me may send you an e-mail on our behalf asking for a review; for this, Judge.me receives your name, your e-mail address and the products you ordered. Legal basis: our legitimate interest in feedback on our products (Art. 6(1)(f) GDPR); you can object at any time. The European Commission has adopted an adequacy decision for the United Kingdom (Art. 45 GDPR).
Online withdrawal function
If you withdraw from a contract through "Withdraw from contract here", we process the data you enter (name, e-mail address, order details and your statement), send you an acknowledgement of receipt by e-mail and keep the statement as proof. Legal basis: compliance with our legal obligations (Art. 6(1)(c) GDPR).
Cookies and Local Storage
The shop sets technically necessary cookies and similar entries in your browser (e.g. for the shopping cart, checkout, country and language, security, and whether the newsletter window has already been displayed). They are strictly necessary for us to provide the service you have requested (Section 165(3) TKG 2021, Art. 6(1)(f) GDPR). We only set analytics or advertising cookies if you have given your prior consent (Section 165(3) TKG 2021, Art. 6(1)(a) GDPR); you can withdraw your consent at any time with effect for the future.
Your Rights
In principle, you have the rights of access, rectification, erasure, restriction of processing, data portability, withdrawal of consent and objection. You can object at any time to the processing of your data for direct marketing (Art. 21(2) GDPR). If you believe that the processing of your data infringes data protection law, you can lodge a complaint with the Austrian Data Protection Authority (dsb.gv.at).
Storage Periods
We keep order and invoice data for seven years (Section 132 of the Austrian Federal Fiscal Code, BAO), newsletter data until you unsubscribe, and inquiries for as long as needed to handle them and any follow-up questions.
